The club argued that the applicant sought to take unfair advantage of the reputation attached to its “West Ham United” trade marks. However, the EUIPO found that West Ham had not demonstrated sufficient reputation within the EU market (a prerequisite for relying on Article 8(5) EUTMR under the EUIPO guidelines).
