Our pre-publication advice encompasses:

Reputation management advice

We provide reputation management advice to clients facing the publication of defamatory allegations or private information. We focus on strategies to prevent or otherwise limit the scope of what is threatened to be published. We frequently work in conjunction with PR specialists to develop a rapid response which aligns with our client’s objectives.

Clients are usually forewarned that content which features their private information is due to be published, and this may be communicated via a journalist, broadcaster or publisher. This means there is a short period of time in which to seek legal advice. We react swiftly and decisively to take appropriate action on behalf of clients facing potential reputational damage or an invasion of privacy.

Post-publication

Where a client has been unable to instruct legal advisors to limit the scope of defamatory content or the extent of private information published, we can promptly provide bespoke post-publication advice and guidance.

Following the publication of contentious content either in print, online (including social media), or by broadcast, we will assess content before advising on potential next steps, which can range from a warning letter to full scale litigation.

Ultimately, the route taken will be dependent upon our client’s objectives and any financial cost the client wishes to commit to, both of which are discussed at the outset.

Content clearance advice

We provide clearance advice for clients who publish content, whether digital, print or broadcast, to ensure any elements are not legally problematic. We carry out an assessment in order to limit the risks of any successful libel or privacy complaints and provide advice in relation to potential contempt and other media related issues.

We have acted for publishers, broadcasters and film writers across a range of creative sectors, including publishing, film and television. We work as an extension of our clients’ teams, both on an ongoing basis or for one-off projects.
