Commercial contract and financial disputes
Commercial contract disputes can disrupt businesses, damage relationships and cause financial loss.
We regularly support businesses and individuals on a range of disputes arising from a business or commercial arrangement and we help parties understand their rights and obligations and act to seek a swift and satisfactory resolution.
We are experts in supporting clients across the full scope of commercial disputes including:
- A breach of contract
- Payment disputes
- Disagreements over the interpretation of contract terms; and
- Disagreements relating to contract delivery.
We also support clients experiencing financial disputes. These might occur when one party fails to pay the other party for work undertaken, payment is less than believes they are entitled to, or a contract is terminated early, leaving a remaining balance on the account.
Commercial contract disputes typically arise where there are ambiguities in the contract; where one party fails to meet its contractual obligations, where there is a change in circumstances; or where one party has more leverage within the agreement.
We seek an array of remedies on behalf of our clients including compensatory damages payments, injunctions and contract cancellation or rescission.
Recent work includes:
- We represented a football club in a claim against a firm of contractors for the substandard design and installation of a FIFA 2* certified football pitch. The substandard pitch led to serious drainage and levelling issues which resulted in the cancellation of match fixtures.
- Acted for a large Belgian company in a contractual dispute concerning the supply of farming equipment to a UK client.
- Represented an aviation maintenance company in a contractual dispute in which the aircraft at the centre of the dispute had been removed from the jurisdiction. A claim was issued for breach of contract, trespass and conversion.
- We are acting for a spa company on a breach of contract claim for c.£80k with their cleaning suppliers where the cleaning suppliers obtained judgment in default prior to us acting. We have applied to set the judgment aside, have prepared a detailed defence and have obtained an injunction against the other side and bailiff company to prevent enforcement of the judgment.
- Acted for an RTM company in a £10m+ claim against a national housebuilder for significant fire safety breaches in the construction of a 15-storey building.
