Triplark Limited
We are acting for Triplark Limited in respect of claims arising out of c. £5m worth of service charge arrears at a block of 194 flats in North London which have accrued over six years. This involves 31 county court claims, a Section 27A application involving more than 50 of the flats seeking a determination in relation to 12 years’ worth of arrears; and a possession claim following judgment in default. The extant litigation includes a High Court breach of trust claim against a former statutory manager worth circa £3.5million and an appeal in the Court of Appeal of a High Court judgment about the landlord’s ability to complete a hot water and heating system replacement scheme.
