Our team has considerable expertise in and experience of Arbitration.
Arbitration is one of the most commonly used forms of Alternative Dispute Resolution and it can enable parties to resolve a dispute without going to court, avoiding litigation which can be lengthy and expensive.
It is a formal binding process where both parties will agree to a chosen impartial third party, an Arbitrator, who can be chosen due to their expertise, and who listens to both sides of the dispute in order to make a binding decision.
There are multiple benefits to arbitration including that it can generally be enforced in most countries after a relatively short time, it is faster, can be more cost-effective and offers a degree of confidentiality as hearings are usually private.
Recent work includes:
- We prepared an application for an arbitrator to resolve a property dispute whereby it was considered that some of the building work was substandard. An arbitration took place which resulted in a successful award for our client.
- We represented a construction company in a contractor dispute and gained a favourable award via effective supporting statements and instructions to expert. We acted in all elements throughout the arbitration, advising the client continually.
